Defense attorneys for convicted Boston Marathon bomber Dzhokhar Tsarnaev say their client deserves a new trial – this time somewhere far from Boston.
A different venue is needed “due to continuous and unrelenting publicity” in Boston, where Tsarnaev was found guilty on 30 counts, including 17 that carry a death sentence, according to a motion filed at the Moakley United States Courthouse on Monday, Boston Globe reports.
Tsarnaev’s defense team said jurors were exposed to news coverage of the trial through social media.
“The social media activity of individual jurors and of their social media contacts is highly relevant to the question of venue, because it further demonstrates a constitutionally-intolerable level of risk to the fairness of the trial created by intense and widely-diffused public feeling in eastern Massachusetts before and during the proceedings,” the court filing states.
Significant portions of the 39-page filing – including portions outlining the so-called “social media activity” of members of the jury – were redacted before being released to the public.
